1 AN ACT
2 RELATING TO SPECIAL LICENSE PLATE PROGRAMS; AMENDING SECTION 49-402C, IDAHO
3 CODE, TO PROVIDE FOR COLLECTION OF A SIX THOUSAND DOLLAR NONREFUNDABLE FEE
4 FROM THE SPONSORING ENTITY OF ANY SPECIAL LICENSE PLATE PROGRAM APPROVED
5 AFTER JANUARY 1, 2007, AND TO PROVIDE FOR DEPOSIT OF THE FEE AND ALL PRO-
6 CEEDS FROM THE SALE OF THE SPECIALTY PLATE PROGRAM APPROVED AFTER JANUARY
7 1, 2007, TO THE STATE HIGHWAY ACCOUNT.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Section 49-402C, Idaho Code, be, and the same is hereby
10 amended to read as follows:
11 49-402C. SPECIAL LICENSE PLATE PROGRAMS -- STANDARDIZED PLATE COLOR AND
12 DESIGN -- FEE FOR DESIGN AND DEVELOPMENT OF PLATE. (1) It is the intent of the
13 legislature that special license plates issued by the department be readily
14 recognizable as plates from the state of Idaho without losing the uniqueness
15 for which the special plate was designed and purchased. In addition, the leg-
16 islature finds that the department can operate in a more efficient, cost-ef-
17 fective manner by conforming special plates to a basic color and design.
18 (2) No special license plates and no special license plate programs in
19 existence on or before June 30, 1998, shall be affected by the provisions of
20 this section. On and after July 1, 1998, any new special license plate program
21 authorized or any redesign of an existing special license plate, shall use the
22 same red, white and blue background as the standard issue of license plates
23 described in section 49-443, Idaho Code, except that:
24 (a) The identification of county shall be omitted;
25 (b) The word "Idaho" shall appear on every plate;
26 (c) The inscription "Scenic Idaho" may be omitted without legislative
27 consideration and approval; and
28 (d) No slogan shall be used that infringes upon, dilutes or compromises,
29 or could be perceived to infringe upon, dilute or compromise, the
30 trademarks of the state of Idaho, including, but not limited to, "Idaho
31 Potatoes ," "Grown in Idaho ," "Famous Idaho Potatoes " or "Famous
32 Potatoes ."
33 The provisions of this section shall not apply to the plate designs issued
34 pursuant to the provisions of section 49-417, Idaho Code.
35 (3) Any redesign required for a special plate to conform with legislative
36 intent and the provisions of this section may be done in a manner similar to
37 that used to produce the original design.
38 (4) The special plates shall conform in all other respects with the pro-
39 visions of section 49-443, Idaho Code, relating to visibility requirements,
40 display of registration number, time period for validity of plates, and reser-
41 vation of plate numbers.
42 (5) A nonrefundable fee of six thousand dollars ($6,000) shall be col-
43 lected from the sponsoring entity of any special license plate program

1 approved after January 1, 2007. The purpose of the fee is to provide the
2 department with revenues sufficient to cover costs to the department associ-
3 ated with design, development and implementation of a new special license
4 plate program. The department shall not be authorized to proceed with design,
5 development or implementation of any special license plate program approved
6 after January 1, 2007, until such fee has been paid in full. The fee and all
7 proceeds from the sale of the specialty plate program approved after January
8 1, 2007, shall be deposited to the credit of the state highway account.
9 (6) Unless otherwise specifically provided, no special license plates
10 shall be issued to motor vehicles with a registered maximum gross weight in
11 excess of twenty-six thousand (26,000) pounds, or any motor vehicle registered
12 under section 49-434(5), Idaho Code, or section 49-435, Idaho Code.
13 (67) Following an introductory period of three (3) years during which the
14 provisions of this subsection shall not apply, if, during both years of any
15 following two (2) consecutive years, fewer than one thousand (1,000) plates
16 are issued in each of those two (2) consecutive years, the department shall
17 discontinue that special license plate program and no new plates shall be
18 issued nor shall any existing plate be renewed upon its expiration. The provi-
19 sions of this subsection shall apply to sections 49-416, 49-417, 49-417A,
20 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-419, 49-419A, 49-420, 49-420B,
21 Idaho Code, and any other special license plate programs created on and after
22 July 1, 2002.
STATEMENT OF PURPOSE
RS 15990
This legislation would not restrict new license plate designs.
It would cover cost for set up and graphics. Funds derived from
new plates would accrue to the Idaho Transportation Department
Highway Fund.
FISCAL NOTE
This will be positive for the Idaho Transportation Department
depending on the sale of new plates.
