AN ACT
making an appropriation to the department of emergency and military affairs for a border radar system.

Be it enacted by the Legislature of the State of Arizona: Section 1. Appropriation; border radar lease; exemption A. The sum of $50,000,000 is appropriated from the state general fund in fiscal year 2006-2007 to the department of emergency and military affairs to lease or purchase a ground based radar system integrated with cameras for the Southern Arizona border for border protection as soon as possible. The location and implementation of the radar system shall be established by the department of emergency and military affairs in cooperation and consultation with the department of public safety, the United States department of defense, the United States department of homeland security, the United States border patrol military facilities on the border, representatives of nearby Indian tribes, the bureau of land management, local sheriffs and chiefs of police near the border and private property owners on the border. B. The appropriation in subsection A of this section shall be reduced by any amount of monies expended by the United States government on a ground‑based radar system as determined by the department of emergency and military affairs and the amount of the reduction shall revert to the state general fund. C. Except as otherwise provided in subsection B of this section, the appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations. |
