1 AN ACT
2 RELATING TO JUDGES; AMENDING SECTION 59-502, IDAHO CODE, TO REVISE PROVISIONS
3 APPLICABLE TO SALARIES OF JUDGES AND TO MAKE TECHNICAL CHANGES.
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. That Section 59-502, Idaho Code, be, and the same is hereby
6 amended to read as follows:
7 59-502. SALARIES OF JUDGES.
8 (1) (a) Commencing on July 1, 1998 2006, the salary of the justices of
9 the supreme court shall be ninety one hundred ten thousand seven five hun-
10 dred ninety-one dollars ($90,791110,500) per annum, and the salary of the
11 judges of the district courts shall be eighty-five one hundred three thou-
12 sand ninety-five six hundred dollars ($85,095103,600) per annum.
13 (b) Commencing on July 1, 1999 2007, the annual salaries salary of the
14 justices of the supreme court shall be one hundred fourteen thousand nine
15 hundred dollars ($114,900) per annum and the annual salaries salary of the
16 judges of the district courts shall be increased by four percent (4%), and
17 again commencing one hundred seven thousand seven hundred dollars
18 ($107,700) per annum.
19 (c) Commencing on July 1, 20008, the annual salary of the justices of the
20 supreme court shall be one hundred nineteen thousand five hundred dollars
21 ($119,500) per annum and the annual salaries salary of the judges of the
22 district courts shall be increased by three and one-half percent (3 1/2%),
23 and again commencing one hundred twelve thousand dollars ($112,000) per
24 annum.
25 (d) Commencing on July 1, 20019, the annual salary of the justices of the
26 supreme court shall be one hundred twenty-four thousand three hundred dol-
27 lars ($124,300) per annum and the annual salaries salary of the judges of
28 the district courts shall be increased by four and one-half percent
29 (4 1/2%), and again commencing on July 1, 2004, the annual salary of the
30 justices of the supreme court and the annual salaries of the judges of the
31 district courts shall be increased by two percent (2%) one hundred sixteen
32 thousand five hundred dollars ($116,500) per annum.
33 (2) Salaries of magistrates shall be as prescribed by chapter 22, title
34 1, Idaho Code.
35 (3) Salaries shall be paid on regular pay periods not less frequently
36 than monthly as determined by order of the supreme court as due out of the
37 state treasury, but no justice of the supreme court or judge of the district
38 court or magistrate shall be paid his salary, or any part thereof, unless he
39 shall first take and subscribe an oath that there is not in his hands any mat-
40 ter in controversy not decided by him, which has been finally submitted for
41 his consideration and determination thirty (30) days prior to his taking and
42 subscribing said oath.
43 (2) For the fiscal year commencing July 1, 2005, and ending June 30,

1 2006, only, the salaries of the chief justice of the supreme court, justices
2 of the supreme court, court of appeals judges, administrative district judges
3 and district judges shall be temporarily increased by one percent (1%) if the
4 state controller certifies to the secretary of state that the unexpended and
5 unencumbered balance of the general fund on June 30, 2005, exceeded
6 $124,000,000.

1 AMENDMENTS TO SECTION 1
2 On page 1 of the printed bill, in line 8, delete "(a)"; and delete lines
3 13 through 32 and insert: "Commencing on July 1, 1999, the annual salaries of
4 the justices of the supreme court and the annual salaries of judges of the
5 district courts shall be increased by four percent (4%), and again commencing
6 on July 1, 2000, the annual salary of the justices of the supreme court and
7 the annual salaries of judges of the district courts shall be increased by
8 three and one-half percent (3 1/2%), and again commencing on July 1, 2001, the
9 annual salary of the justices of the supreme court and the annual salaries of
10 judges of the district courts shall be increased by four and one-half percent
11 (4 1/2%), and again commencing on July 1, 2004, the annual salary of the jus-

STATEMENT OF PURPOSE
RS 16240A1
This bill would increase the annual salary of justices of the
Supreme Court, judges of the Court of Appeals, district judges
and magistrate judges beginning July 1, 2006, by providing
approximately a 3% increase and an adjustment of 3%, for a total
of approximately 6%.
FISCAL NOTE
The estimated fiscal impact of the increased cost of salary and
benefits, which are paid from the general fund, is $870,700 for
the fiscal year.
